(Minghui.org) An elderly practitioner who moved to our area was tricked in to signing the “three statements” during the CCP’s campaign to “zero out” Falun Gong practitioners last year. A police officer told her, “You can keep practicing Falun Gong after you sign the papers. We don’t care. But if you don’t sign, we’ll take you away right now.”
The practitioner was scared and signed them. She was, however, arrested later that year when she went out to clarify the truth.
She was tried this April, and practitioners in the entire area sent forth righteous thoughts for her. Some practitioners even went in close proximity to the courthouse on the day of the trial to send righteous thoughts. Her son came from out of town to defend her.
Her son asked the judge, “Your honor, my mother is a housewife who is illiterate. When and how could she go against the law or obstruct justice [as charged]? Did she violate the Constitution, criminal law, marriage law, or any other law?” The judge was speechless, while there was laughter from those in the audience.
Her son continued, “If you cannot point it out, the crime doesn't exist, and she is here on false pretenses. For example, if I say you killed two people yesterday but I cannot point out who you killed, wouldn’t you say that I was an accuser making a false accusation?
“I couldn't find any legal basis that says ‘practicing Falun Gong is against the law,’ after I went through all the relevant Chinese laws. As a judge, you know clearly that my mother did not commit any crime. Why do you want to sentence her? You might say you are directed to by higher authorities. Then what about your obligation to follow the law and uphold justice?
“Both you and I know that the law is the lowest standard for people to abide by, while someone’s conscience is the highest. You know very well that my mother and all other practitioners are good people; they have not done any bad things. But you framed them by fabricating some evidence to imprison them. How could you be at peace with your conscience? Won’t you feel sorry if you or your family members run into a misfortune in the future when heaven punishes you?”
The practitioner’s daughter then weighed in, “My mother was paralyzed and bedridden for over 10 years. The whole family was in distress, but no one else cared. Now, she recovered after doing the Falun Gong exercises. Our family is relieved and now lives well. But you want to have my mother imprisoned. Please tell us what crime she has committed? Shall we take her to your home if she has a relapse?”
The judicial officers looked at each other and didn’t respond. The judge finally said, “You can take your mother home.”
Three days later, someone from the court delivered a verdict that sentenced the mother to three and a half years in prison. When the practitioner's family heard this, they asked, “Are you guys making jokes? How can you suddenly change your mind?”
The person replied, “The judge was wrong that day. Our leader directed the change.”
One of the family members responded, “It is our responsibility to protect our mother. We will not let her go by any means. We’d even go to prison on her behalf!”
The person who delivered the sentencing papers was at a loss and simply said, “Let’s go back and reconsider it.”
The practitioner’s son told him, “Please tell your leader to carefully study Articles 35 through 39 of the Constitution, and also Articles 251 through 254 of the Criminal Law.”
The local practitioners continued to send forth righteous thoughts throughout the process.
The court informed the family three weeks later, “It's okay now. She can stay at home and do her exercises.”
This is the first example of a practitioner winning a court case in our area. It demonstrates:
