(Minghui.org) Falun Gong practitioner Mr. Du Changyin was subjected to an unlawful trial on February 6, 2015, at the Huanggu District Court, in Shenyang, Liaoning Province. His lawyer defended his innocence, but the lawyer was interrupted many times by the judges.
Presiding judge Duan Lei asked practitioner Du during the trial, “Have you been convicted before?” “No,” answered Mr. Du.
The prosecutor read his case document, which stated that Mr. Du had been locked up in a forced labor camp for persevering in practicing Falun Gong. The presiding judge asked Mr. Du, “Is this true?” His defense lawyer rebuked, “The labor reeducation system has been abolished. The system violates the Constitution. Such unlawful lock-up cannot be taken as a previous conviction.” The judge did not respond and kept silent on this issue after that.
The Chinese Communist Party is manipulating the judicial system to persecute Falun Gong practitioners in the name of the law. Show trials are conducted to sentence innocent practitioners into prisons.
Practitioner Du Changyin, 46, is from Shuiquan Village, Shibajiazi Township, Tu County, Liaoning Province. He was taken away by police on the evening of March 19, 2014, while he was working at a bridge construction site near north Shenyang Railway Station. He was detained in Heping District Detention Center, then transferred to Huangu District Detention Center on June 12. He has been detained for over one year so far.
His trial on February 6 was held on the third floor of the court building. Only two family members were allowed to enter the room, though the court should not have the limit.
The presiding judge began the trial by reading a list of court requirements. The prosecutor then read the allegations against practitioner Du, which included his using a cell phone for an online chat on Tencent QQ, an instant message system in China.
The judge asked Mr. Du, “Do you admit that you violated the law?” “No. Based on the item 89 of the Constitution...” responded Mr. Du. But the judge interrupted him angrily, “Don't speak nonsense. Do you admit you violated the law?”
“I am not guilty. The Constitution stipulates that everyone has freedom of belief and speech. What I chatted about was traditional Chinese culture,” said Mr. Du. Judge Duan Lei stopped him, “Nobody believes such an explanation.”
The lawyer asked Mr. Du, “Were you tortured in the detention center?” “I was brutally beaten six times, and deprived of sleep for 24 consecutive hours. And I was forced to sit on a cement floor overnight,” said Mr. Du.
The defense lawyer stated, “The police officers in the detention center violate the law and infringe basic human rights. The law-enforcement officers violate the law.” The presiding judge said right away, “We don't talk about that in court.”
The prosecutor presented some images from Mr. Du's cell phone during the trial. The lawyer defended Mr. Du, “The cell phone is my client's personal property. Chatting online is his freedom of speech. He spread the messages advising people to be good via QQ. There is nothing wrong with that. Falun Gong has spread to over 100 countries around the world. Falun Gong is based on the principles of Truthfulness-Compassion-Forbearance and teaches people to be good. Everyone can find this online. If you judges go online and see this information, is that also violating the law? If not, why is my client being charged for that?”
The judges did not respond. The prosecutor read a few more allegations, which were rebuked one by one by the lawyer. The lawyer's reasoned defense in court made the judges feel embarrassed.
The lawyer said to the judges at the end, “I hope you are clear about the current situation and know the facts about Falun Gong and the unlawful persecution. Falun Gong teaches people to be good and kind and to improve their morality. Those who have persecuted righteous beliefs have historically not had good results.” The presiding judge stood up angrily and said while pointing at the lawyer, “Don't say anything more. The trial is adjourned.”
This show trial ended in less than one hour. People in attendance witnessed that the judges did not conduct the trial based on the law, but simply carried out the CCP's persecution policy.
