(Minghui.org) Falun Gong practitioner Ms. Tian Xin was tried for the fourth time on March 6, 2015, in the Ke District Court. Her attorney stated that the evidence used against Ms. Tian was fabricated and that the prosecutor should be held accountable for such a breach of justice.
Ms. Tian was charged under Article 300 of China's Criminal Code--“Using a cult organization to undermine law enforcement”--an allegation routinely used by the communist regime to arbitrarily arrest and imprison practitioners as part of its nationwide campaign of persecution of Falun Gong.
Ms. Tian's attorney listed how the court had violated legal procedures:
1. No verdict was declared at the initial trial on October 31, 2014, and the case was closed. However, the prosecutor continued to fabricate evidence, intending to bring false charges against Ms. Tian.
2. The current indictment had the same document number and same date as the initial one (October 31, 2014), but the contents were different. The defense attorney asked the prosecutor which one was correct.
The attorney pointed out that tampering with the evidence was a serious violation of legal procedures and of justice itself. He therefore ask the court to remove the judge for violating the law. The presiding judge adjourned the trial at 3 p.m.
The hearing resumed at 4 p.m. The judge rejected the attorney's request without explanation.
In response to the “new evidence” used in the trial, the attorney noted that the prosecutor used completely fabricated evidence to charge Ms. Tian. He stated that the prosecutor should be held accountable for these criminal acts.
In the final defense statement, the attorney argued that Ms. Tian had not violated any law and should be immediately released. As a Chinese citizen, she has the freedom to practice Falun Gong – a right protected by China's Constitution.
After more than three hours, the prosecutor could not come up with any legal basis to prove the validity of the “evidence.” The trial was temporarily adjourned, to resume at a later date.
