The Charges Against Jiang Zemin: A Detailed Indictment for Crimes Against Humanity, Treason, & Genocide

On behalf of humanity, and of its largest segment, the People of China:

Jiang Zemin, current occupant of the office of President of the People's Republic of China, I hereby charge you with multiple counts of genocide, of crimes against humanity, and of willful treason against the People and Nation of China.

• You have ordered a crackdown on adherents of Falun Gong, and renewed it continuously over the span of nearly two years. You have ordered it be carried out to "break their spirits, bankrupt them, annihilate their bodies," and "if they are killed, it will be counted as suicide." You have proclaimed "war on Falun Gong" throughout China and brought occupation-style tactics against its members in all provinces of Mainland China. This began contrary to Chinese law and continues so, despite later attempts at justification under an inapplicable "xx control" law.

• Many of your uniformed and plainclothes police, military, and law enforcement agents openly beat, torture, kidnap, extort, rape, and kill Falun Gong members without cause, under threat of loss of rank, position, and livelihoods from you and their superiors. They cite "direct orders from above," regardless of their ranks.

• Those agents openly deny and defy the authority of constitution and law, and their duty to act in accordance with constitution and law.

• You have ordered and allowed continual blockage of citizen's attempts for redress through normal constitutional channels, and any other formal and informal channels which present themselves to justifiably concerned citizens.

• Your courts deny time and competence of defense and enforce circumventions of due process. Trials which are by law to be public are held in secret; obvious false witness accorded as legitimate "evidence;" legal procedure is disregarded; guilt and sentences are determined before trial; notifications of charges are withheld; access to witnesses is denied; appeals on any grounds are denied.

• You have ordered your legal system to deny access to lawyers, to law, and to knowledge of the law. Those with knowledge of law, and of their constitutional rights as citizens, receive greater torture and maltreatment.

• Your mental hospitals and drug-treatment centers have become torture camps where doctors and medical personnel inject damaging drugs into the healthy bodies of Falun Gong members.

• Your government buildings, by your orders, have become prisons and torture camps, holding law-abiding Falun Gong members without charges, without due process, and beyond legal limits. Further prisons and torture camps have been paid for by the government and are being constructed. Those placed in these prisons and camps are subject to torture, rape, murder, and forced labor without compensation and without limitation as to type of work or effects on health. Outside and independent inspectors of known camps are knowingly shown false depictions of conditions, in the attempt to deflect attention from gross violations of international and Chinese law.

• Your media knowingly broadcast libel, false reports, and stage sensational "events" which directly cause injury and death, demonstrating willful official disregard for truth and the safety and well-being of citizens of all nations.

• Your officials inflict widespread and wide-ranging miseries on Falun Gong members: demanding ruinous fines for non-existent offenses, withholding marriage and birth certificates, forcing divorces, performing abortions to lengthen detention times, transfering children to state-selected foster homes when one parent is captured, refusing entry into schools, shutting off utilities, revoking pensions, stealing material goods and food, punishing people for their relatives' activities, and preventing movement on "suspicion of going to Beijing to appeal."

• Violent criminals have been openly used as police irregulars to inflict beatings in Tiananmen Square, train stations, and other public places.

• Your embassies knowingly libel and harass foreign citizens, intentionally violate the laws of the countries they are in which they are situated, and refuse to perform the duties entrusted to them to ensure the safety, travel, and registration of your citizens.

• You and your agents have acted with premeditation, in conspiracy, from ambush, with cruelty, with barbarity, intending to inflict maximum amounts of pain and suffering to Falun Gong members.

• You allow the same injustices to be inflicted on supporters and potential supporters of Falun Gong members, and on the general citizenry of China, expressly attempting to prevent further support of Falun Gong members.

• At least 200 Falun Gong members have died, tens of thousands have been tortured, hundreds of thousands forcibly have been separated from their relatives and livelihoods, and millions have been harassed. An unknown large number of Falun Gong members are missing, presumed detained or evading capture or dead (depending on the circumstances of their disappearances).

These actions document your success in implementing your intent to destroy, in whole and in part, Falun Gong and its members as a group defined by its faith, by these means:

(a) killing members of the group;

(b) causing serious bodily or mental harm to members of the group;

(c) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

(d) imposing measures intended to prevent births within the group;

(e) forcibly transferring children of the group to another group.

This is, in all points, the definition of "genocide."

You are individually responsible and liable for these violations, having ordered their commissions, failed to prevent their commissions, provided the means for their commissions, or planned for their commissions.

These actions document your success in systematically and in large scale instigating and directing by your government, against Falun Gong members and supporters:

(a) murder

(b) extermination

(c) torture

(d) enslavement

(e) persecution on political grounds

(f) institutionalized violation of fundamental human rights and freedoms recognized in the United Nations Charter, on religious grounds and resulting in serious disadvantage

(g) arbitrary forcible transfer of population

(h) arbitrary imprisonment

(i) forced disappearance of persons

(j) rape and other forms of sexual abuse

(k) other inhumane acts which severely damage physical or mental integrity, health or human dignity

This constitutes, in all points, "crimes against humanity."

You are individually responsible and liable for these violations, having ordered their commission, failed to prevent their commission, provided the means for their commission, or planned for their commission.

In your persecution of Falun Gong, you have incited rebellion against the Constitution and People of China, and on seeing its success, continued that incitement. This is treason against the People and Nation of China.

As a courtesy, I pass along word from Humanity and the People of China: lift your ban on Falun Gong, and nullify those uses of authority which inflict such injustices. We call for a full, impartial, and open account of actions taken regarding this matter, both in causing and furthering this repression, and in resisting and dissipating it. We call for proper and unbiased investigations into crimes and alleged crimes committed during this time, including yours. We call for fitting mitigations and restitutions for actions during this time, including retributions where justice for Humanity and the People of China is best served by retributions.
